These Terms of Service (“Terms”) govern your use of Boring Marketing’s website, API, CLI, and related services (the “Service”). By using the Service you agree to these Terms.

The Service

Boring Marketing provides marketing-intelligence software: crawls, ranked opportunities, briefs, and drafted content. The Service may be accessed through the web app, REST API, CLI, or MCP integration.

Accounts

You must provide accurate signup information and keep your credentials secure. You are responsible for activity that occurs under your account. Notify us promptly of any unauthorized access.

Subscriptions and credits

The Service is billed as a monthly subscription. Each tier includes a monthly grant of credits that you spend on refreshes, briefs, drafts, and other operations.

Credits roll over. Unused credits from a billing cycle carry into the next cycle as long as your subscription remains active.

Cancel anytime. You may cancel your subscription at any time. Cancellations take effect at the end of the current billing cycle; you retain access through that date.

Refunds. Subscription fees are non-refundable except where required by law. Credits are not redeemable for cash.

Failed runs. You are not charged for service-level failures. Credits are deducted only on successful terminal completion of an operation.

Acceptable use

You agree not to use the Service to: (a) violate any law or third-party right; (b) crawl, scrape, or analyze properties you do not own or have explicit permission to analyze; (c) generate content that is defamatory, fraudulent, or that infringes intellectual-property rights; (d) reverse engineer the Service or attempt to extract source code; (e) probe, scan, or test the vulnerability of any system without authorization; or (f) resell the Service except under a written reseller agreement.

Intellectual property

You retain ownership of the URLs, content, and inputs you submit and the outputs the Service generates for you (briefs, drafts, opportunities). We retain ownership of the Service itself, including the underlying platform, models, scoring systems, and proprietary methodology.

Confidentiality

Each party will protect the other’s confidential information using the same care it uses for its own confidential information of similar sensitivity, and at minimum reasonable care. Confidential information does not include information that is or becomes public through no fault of the receiving party.

Disclaimer

The Service is provided “as is” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated outputs are accurate or fit for any particular purpose. You are responsible for reviewing outputs before relying on them.

Limitation of liability

To the maximum extent permitted by law, in no event will Boring Marketing’s aggregate liability arising out of or relating to the Service exceed the amount you paid us in the twelve months preceding the claim. Neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data.

Indemnification

You agree to indemnify and hold harmless Boring Marketing from claims arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party right (including intellectual-property rights).

Termination

We may suspend or terminate your access if you materially breach these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising from these Terms will be resolved in the state or federal courts located in Delaware, and each party consents to that jurisdiction.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
